Security Clearance Application Process

recruitment employment headhuntingOur security clearance lawyers represent and advise government contractors, federal employees and military employees during the security clearance application process.  It is often the case that individuals have questions as the application process unfolds about past security or conduct issues. It is important to get legal advice before submitting security clearance applications. Not completing the application correctly can cause major problems later.

Completing the Security Clearance Application

All employees whose positions require access to sensitive information or restricted areas are required to complete an application form known as the Standard Form 86 Questionnaire for National Security Positions (SF-86) or Electronic Application (eApp). Providing information in the SF-86 or eAppis voluntary; however, completing the form truthfully is critical to the process of successfully obtaining a security clearance. Once a security clearance application is completed, it is generally submitted to the federal agency conducting the adjudication for the security clearance for review and determination.

How We Can Help

We frequently advise individuals about their questions in completing the SF-86 or eApp. It is important to answer the questions truthfully. Where a disclosure needs to be made it is often important to explain the context behind the issue. For instance, if there has been drug use, has the use ended? What have you learned in the process? When did it end? There are many reasons to get accurate advice about completing your security clearance questionnaire. One of the most important is to avoid having to correct your answers later which can cause questions about candor or honesty.
